404Ware Terms of Service

These Terms of Service ("Terms") govern your use of the 404Ware website (the "Site") and your purchase of products from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, you must not use the Site.

1) Who We Are & Contact

The Site is operated by 404Ware (a trading name). All enquiries and notices should be sent to hello@404ware.com.

These Terms, together with our Refunds & Faults Policy and Privacy Policy, form the agreement between you ("you", "your") and 404Ware ("we", "us", "our").

2) Eligibility & Accounts

• You must be at least 18 years old (or the age of majority where you live) to place orders.
• If you create an account, you must provide accurate information and keep your credentials secure.
• You are responsible for activity under your account and must notify us of unauthorised use.

3) Orders & Contract Formation

• Your order is an offer to buy. We may accept or reject any order at our discretion.
• Order confirmation emails acknowledge receipt but are not acceptance. Acceptance occurs on dispatch (or when we otherwise indicate acceptance).
• If we reject after payment, we will refund you in full.

4) Pricing, Payment & Taxes

• Prices are shown in GBP (£) and include UK VAT unless stated otherwise. International orders may incur duties/taxes that you are responsible for.
• Payment methods are as shown at checkout. Payment is captured when you place the order (unless stated otherwise).
• If a pricing error is identified, we may contact you to cancel or adjust. You may accept the corrected price or cancel for a refund.

5) Production, Fulfilment & Delivery

• All products are made to order via our manufacturing partner.
• Production and shipping times vary; estimated timeframes are shown at checkout or in your order emails.
• Risk in the goods passes on delivery to the address you provide (or to the carrier where applicable).
• We are not liable for delays caused by customs, carrier issues, or events beyond our reasonable control.

6) Returns, Refunds & Faults

Because products are produced on demand, we only accept returns for manufacturing faults, production errors, or transit damage reported within the required time limits. Full details are set out in our Refunds & Faults Policy. All claims are subject to inspection and approval by us and our manufacturing partner. Do not send items back without written authorisation.

7) Advertising, Promotions & Social Media

• We advertise on platforms including Google, Meta and TikTok. Offers and promo codes are valid only for the stated period and conditions.
• Platform-specific terms (e.g., ad restrictions, content policies) may apply and are outside our control.
• If you submit or tag user-generated content (e.g., reviews, photos), you grant us a non-exclusive, royalty-free, worldwide licence to use, display and share that content for marketing and promotional purposes.

8) Intellectual Property

All Site content (text, graphics, logos, images and product descriptions) is owned by or licensed to 404Ware and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9) Acceptable Use

• Do not use the Site for unlawful, fraudulent, harmful or disruptive activity.
• Do not attempt unauthorised access, interfere with security, or use automated means to scrape or harvest data.
• Do not submit content that infringes rights, is defamatory, obscene or otherwise offensive.

10) Data, Privacy & Cookies

We process your personal data in accordance with our Privacy Policy. This includes information necessary to process orders, provide customer support, prevent fraud, and—where you consent—send marketing communications. The Site may use cookies and similar technologies; details and your choices are set out in the Privacy Policy.

11) Disclaimers & Limitation of Liability

• The Site and products are provided "as is" and "as available" to the fullest extent permitted by law.
• We take care to ensure accuracy, but do not guarantee that descriptions or availability are error-free or current.
• To the maximum extent permitted by law, we are not liable for indirect or consequential losses (including loss of profit, revenue, data or business).
• Our liability for defective goods is limited to the remedies described in the Refunds & Faults Policy (replacement or refund).
• Nothing in these Terms limits your statutory rights.

12) Indemnity

You agree to indemnify and hold harmless 404Ware from claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site or violation of law or third-party rights.

13) Termination

We may suspend or terminate access to the Site or your account at any time, with or without notice, if you breach these Terms or for any other reasonable reason. Provisions that by their nature should survive termination (including IP, disclaimers, limitations and indemnities) will survive.

14) Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with a new "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

15) Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. You and we submit to the non-exclusive jurisdiction of the courts of England & Wales. Before taking legal action, please contact us at hello@404ware.com so we can try to resolve matters informally.

16) Miscellaneous

• If any provision is found invalid or unenforceable, the remainder remains in effect.
• We may assign or transfer our rights and obligations; you may not assign without our consent.
• These Terms, together with the policies referenced above, constitute the entire agreement between you and us regarding the Site and purchases.
